The Electronic Communications and Transactions Act - Act No. 25, 2002 is the primary legislation governing the sending of bulk / Unsolicited Commercial Email (UCE). The Data Protection Act 1998 and The Privacy and Electronic Communications Regulations 2003 are the primary governers of sending UCE. This website: http://www.scotchspam.org.uk/ provides some good insight.

The agreement:

  1. We undertake to provide best practice unsubscribe links, tracking and reporting facilities and to distribute your email as best we can to all it's recipients.
    • We do have an enforced limit of 500KB for emails sent via this system.
  2. We require that you pay us and excerise good judgement on (and we will hold you responsible for) the content of the email and the lists of recipients. (we might contact you and ask about the source of lists in certain circumstances), Good judgement includes, but is not limited to:-
    • not re-subscribing someone who has opted out without good reason.
  3. If you have a number of accounts (IE you have more than 1 login to the system) this agreement covers each login seperately.
  4. If we have reason to beleive that you have (or are) sending an email that is not in keeping with the ethos of the system we will discontinue use pending investigation. We will notify you, but will not be obliged to send email emails that have not already gone. If the issue can not be resolved this agreement will be terminated.

CIS allows use of this system to email direct clients only, IE: NOT clients who are at arms length, or clients of someone else. A reasonable test would be: if an email address is on your list and we were to contact that person, would they know who you are?

We are aware that our requirements are more stringent than the law requires, UCE is a contentious field and we have chosen to take a cautious approach.
